To be honest I think the whole issue is so ideologically fraught and depends so heavily on subjective judgements that I'm quite skeptical of attempts to prove scientifically that one particular position is the "correct" one.

Which is not to say that good arguments can't be made from a legal and/or ethical POV.

The critique isn't so much about putting forward a "correct" position, as showing that Cass's methodology was so utterly flawed that her conclusions/opinions aren't worth the paper they're written on, and hence should not be used to formulate policy. Though you could easily say it was the other way round: that the policy had already been decided upon and Cass was tasked to find the "evidence" for it.
